MyChecksAI is a tenant referencing platform that helps letting agents and landlords conduct background checks, identity verification, and compliance checks on prospective tenants. By using the service you agree to these terms. If you do not agree, do not use the service.

The service

MyChecksAI provides tools to facilitate tenant referencing, including but not limited to: Right to Rent verification, AML and PEP screening, identity verification, employment and landlord references, insolvency checks, and optional open banking income verification.

The service is provided on a credit or pay-as-you-go basis. Results are delivered to the requesting agent or landlord via the web dashboard and WhatsApp.

We reserve the right to update, modify, or discontinue any feature of the service at any time. We will give reasonable notice of material changes where practicable.

Accounts and access

To use account-based features you must register and keep your login credentials secure. You are responsible for all activity carried out under your account. You must notify us immediately at support@mychecksai.com if you suspect unauthorised access.

Accounts are for business use by letting agents, landlords, and their authorised team members. You must not share access credentials outside your organisation or use the service on behalf of third parties without our prior agreement.

We may suspend or close accounts that are inactive, misused, or in breach of these terms, or where we are required to do so by law.

Credits and payments

Checks are charged on a pay-as-you-go basis or by purchasing credit bundles in advance. Credits are deducted when an applicant completes the referencing form — not when an invitation is sent.

• Credits never expire and remain on your account until used or the account is closed.
• Credits are non-transferable between organisations.
• All prices shown are exclusive of VAT unless stated otherwise.
• Payment is processed by Stripe. We do not store card details.

Refunds. Credits are consumed automatically when a check is initiated. If a technical fault on our part prevents a check from completing we will investigate and, at our discretion, restore credits or issue a refund. We do not refund credits where a check returns a result you disagree with, where a tenant does not proceed, or where you change your mind after a check has started.

Acceptable use

You must not use the service to:

• Run checks on individuals without a lawful basis or without the individual's knowledge where required by law
• Discriminate unlawfully on the basis of race, religion, disability, gender, age, or any other protected characteristic
• Conduct checks for any purpose other than legitimate tenant or guarantor referencing
• Attempt to access, scrape, reverse engineer, or interfere with the platform or its data
• Submit false, inaccurate, or fraudulent information about applicants or referees
• Resell, sublicense, or white-label the service without our written agreement

Breach of these terms may result in immediate account suspension and, where appropriate, referral to relevant authorities.

Right to Rent and compliance disclaimer

MyChecksAI provides tools and information to assist landlords and letting agents with their compliance obligations. It does not replace your legal duty to conduct Right to Rent checks or comply with the Money Laundering Regulations.

The legal responsibility for conducting a valid Right to Rent check remains with the landlord or letting agent at all times. MyChecksAI is not a substitute for professional legal or compliance advice. You should satisfy yourself that the checks you run meet your specific obligations and that any documentation you rely on is valid.

We do not guarantee that the information provided by third-party verification providers (including Yoti, GoCardless, or AML screening services) is free from error. Results should be considered alongside your own judgement and, where appropriate, professional advice.

Third-party services

The platform integrates with third-party providers including Yoti (identity), GoCardless (open banking), Stripe (payments), Twilio (WhatsApp and SMS), and others. Use of these providers is subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.

Where a third-party service is unavailable or returns an error, we will make reasonable efforts to notify you. We are not liable for delays or failures caused by third-party outages.

Limitation of liability

To the fullest extent permitted by law, RED ALGORITHMS LTD's total liability to you in connection with the service — whether in contract, tort (including negligence), or otherwise — is limited to the amount you paid for the specific check or service that gave rise to the claim.

We are not liable for:

• Loss of profits, revenue, or business opportunity
• Losses arising from decisions made on the basis of check results
• Indirect or consequential losses of any kind
• Losses caused by events outside our reasonable control (including third-party outages, network failures, or regulatory changes)

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

Intellectual property

All content, software, branding, and materials on the platform are owned by or licensed to RED ALGORITHMS LTD. You may not copy, reproduce, or distribute any part of the platform without our prior written consent.

By submitting data through the platform (including applicant information, reference responses, and check results) you grant us a limited licence to process and store that data solely to provide the service to you.

Changes to these terms

We may update these terms from time to time. Where changes are material, we will give reasonable notice by email or via the platform before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
